1. Introduction

Texas Music City Grill & Smokehouse (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect when you visit texasmusiccity.net (the “Website”), how we use it, who we share it with, and the choices you have.

This Website is an informational site for our two restaurants in Tyler and Lindale, Texas. It does not have customer accounts, and it does not take orders or payments itself. Online ordering is handled by Toast on Toast’s own website (see Section 6).

2. Information We Collect

2.1 Information you provide directly

The Website has no contact or signup forms. If you call or email us, or give us your name, phone number or email address in the restaurant or through Toast, we keep what you give us so we can respond to you or provide the service you asked for.

2.2 Information collected automatically

  • Server and security logs: IP address, browser type, operating system, referring page, pages visited and timestamps. Our web host (Bluehost) and our security software (Wordfence) record this to run the Website and to detect and block attacks.
  • Analytics data: if you allow analytics cookies, Google Analytics records how the Website is used, including pages viewed, device type and approximate (city-level) location. See Section 5.
  • Cookie preferences: the choice you make in our cookie banner, so we can honor it on later visits.

2.3 Information from third parties

  • Toast: when you order online, Toast sends us your order and the details needed to prepare and fulfill it, under Toast’s privacy policy.
  • Facebook and Instagram: if you interact with our pages on those services, we see that activity there. The Website displays our upcoming events pulled from our own Facebook pages; this does not send any of your information to Facebook.

3. How We Use Information

  • To operate, secure and improve the Website
  • To understand which pages and locations visitors are interested in
  • To respond to calls, emails and requests, including private event inquiries
  • To prepare and fulfill orders placed through Toast
  • To comply with legal obligations and protect against fraud, abuse and security threats

4. How We Share Information

We do not sell your personal information, and we do not share it for targeted advertising.

We share information only with the service providers that run parts of the Website and our business:

  • Bluehost (website hosting and server logs)
  • Wordfence by Defiant, Inc. (website security; IP addresses of blocked or suspicious requests may be shared with Defiant’s threat network)
  • Google (Google Analytics, loaded through Site Kit; Google Fonts)
  • CookieYes (cookie consent banner and a record of your consent choice)
  • Toast, Inc. (online ordering, point of sale and guest communications)

These providers may use your information only to provide their service to us. We may also disclose information when required by law, court order or to protect our rights or the safety of others, and as part of a sale or transfer of the business.

5. Cookies and Tracking Technologies

A cookie is a small data file stored on your device. The Website uses:

  • Necessary cookies: required for the Website and the cookie banner to work (for example, remembering your cookie choice). These cannot be switched off.
  • Analytics cookies (Google Analytics): set only if you accept them in the cookie banner. They help us understand how the Website is used. Google Analytics is configured not to load until you accept.

The Website does not use advertising or marketing cookies.

You can change your choice at any time using the “Cookie Preferences” link in the footer of every page. If your browser sends the Global Privacy Control (GPC) signal, analytics cookies stay off unless you choose to accept them in the banner. Blocking cookies in your browser settings also works, though some features may not function.

6. Third-Party Services

These services have their own privacy policies, and your use of them is governed by those policies.

7. Your Privacy Rights

7.1 All visitors

You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it. Contact us using the details in Section 12. We will respond within 45 days.

7.2 Texas residents

Texas residents may also request a portable copy of their personal data and may opt out of its processing for targeted advertising, sale or profiling. We do not engage in any of those three activities. If you believe we have not handled a request properly, you may appeal by contacting us again and stating that you are appealing; we will respond within 60 days.

7.3 Residents of other states

If your state’s privacy law gives you additional rights, contact us and we will honor them as the law requires.

8. Data Retention

  • Server and security logs: kept for the period set by our hosting and security providers, generally 30 days or less.
  • Google Analytics data: 14 months.
  • Cookie consent records: 12 months, after which the banner asks again.
  • Emails and inquiries: kept as long as needed to respond and for our records, then deleted.

9. Children’s Privacy

The Website is not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided information to us, contact us and we will delete it.

10. Data Security

The Website uses HTTPS encryption, a web application firewall and malware scanning, and access to personal information is limited to the people who need it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Changes to This Policy

We may update this policy as the Website or the law changes. The “last updated” date at the top will change when we do. For significant changes we will post a notice on the Website.
